1. Acceptance of Terms

By accessing or using expressclarity.ai and any services provided by Express Clarity AI (operated by Align Above AI LLC), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you may not access or use our services.

2. Services Description

Express Clarity AI provides creative communication services, content systems, websites, social media management, AI-powered communication solutions, and related consulting for businesses, ministries, and leaders. The specific scope of services for each client is defined in the applicable service agreement or proposal.

3. Subscription and Billing

• Services are offered on a recurring subscription basis (monthly or bi-weekly, depending on the selected plan)
• Billing begins after your application is approved and your agreement is executed
• Payments are processed automatically according to your selected billing cycle
• Clients may cancel their subscription at any time

4. Payment and Refund Policy

All payments made to Express Clarity AI are non-refundable. Our services involve strategy, creative development, implementation, communication planning, and reserved production capacity. Resources are allocated immediately upon acceptance and payment.

• All payments are non-refundable once processed
• Clients may cancel at any time; however, payments already processed are non-refundable
• One-time packages and setup fees are non-refundable
• Certain services may rely on third-party platforms, AI models, and telecommunications providers; the client is responsible for any third-party usage fees (AI tokens, SMS, email, telephony, API, and platform subscriptions)

5. One Active Deliverable at a Time

To maintain quality, clarity, and strategic focus, each partnership operates through a one-active-deliverable workflow. Once a request is completed or approved, the next request in queue begins. This allows us to deliver premium quality without compromising focus.

6. Client Responsibilities

• Provide accurate and timely information, materials, and feedback
• Respond to approvals and requests within a reasonable timeframe
• Ensure you have the rights to any content or assets you provide to us
• Review and approve deliverables in a timely manner

7. Intellectual Property

Upon full payment, all finalized creative assets and deliverables created specifically for the client belong to the client. Express Clarity AI retains the right to use proprietary tools, frameworks, templates, and methodologies developed in the course of providing services. We may use completed work in our portfolio unless otherwise agreed in writing.

8. Third-Party Services

Some deliverables may rely on third-party platforms, software, or services. Express Clarity AI is not responsible for outages, changes, or limitations imposed by third-party providers. The client is responsible for any third-party subscription or usage costs incurred.

9. Limitations of Liability

Express Clarity AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services. Our total liability shall not exceed the amount paid by the client for the services giving rise to the claim during the preceding billing cycle.

10. Termination

Either party may terminate the service relationship at any time. Upon cancellation, we will complete the active deliverable in progress, if any. No refunds are issued for payments already processed. We reserve the right to decline or discontinue services at our discretion.

11. Governing Law

These Terms & Conditions are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Texas.

12. Changes to These Terms

We may update these Terms & Conditions from time to time. Changes take effect when posted on this page. Continued use of our services after changes constitutes acceptance of the updated terms.
